Who can drive the vehicle?
Only the people listed in the Rental Agreement as authorised drivers are allowed to drive the vehicle.
Allowing anyone else to drive the vehicle is a breach of the Rental Agreement and can have serious consequences. For example, it may void your insurance coverage with us if an unauthorised driver has an accident.
What are your obligations?
You must take reasonable care when driving and parking the vehicle and ensure the vehicle is reasonably maintained. This includes making sure the oil is at the proper level and the tyres have the correct air pressure.
What are our obligations?
We are required to provide you with a vehicle that is safe and roadworthy, evidenced by a current Certificate of Fitness.
What will you need to pay?
You will need to pay the rental amount for the hire period. You are also responsible for fuel and any infringement costs incurred during that period, such as traffic fines or parking tickets.
You may also be responsible for additional costs, including towing costs resulting from traffic accidents or driver error, repair costs if the car is damaged through a breach of the Rental Agreement, and other charges that may apply when the vehicle is returned at the end of the hire period, such as refuelling or cleaning costs if smoking has occurred or a pet has been inside the vehicle.
Is the vehicle insured?
You may make your own insurance arrangements, subject to our approval. Otherwise, you will be covered by our insurance policy.
Our policy covers the market value of the vehicle, as well as liability to third parties resulting from your hire. Different levels of excess are available.
Is this the full agreement?
No. As part of the hire, you are bound by both the Rental Agreement and our Terms and Conditions.
By proceeding with the rental, you acknowledge that you have read and agree to the Rental Agreement and the Terms and Conditions.
Terms and Conditions
1. General
1.1. These Terms and Conditions form part of the Rental Agreement and set out the conditions on which WMK PVT Limited trading as Ride Car Rentals (“we”, “our”, or “us”) agrees to let a motor vehicle (“vehicle”) to the hirer named in the Rental Agreement (“hirer” or “you”).
1.2. Only the people listed in the Rental Agreement as authorised drivers have our consent to drive the vehicle.
1.3. Everyone driving the vehicle must have a valid full NZ or overseas driving licence (translated into English if necessary) that is required for the class of the vehicle.
1.4. We have the right to request two forms of address from within the last 3 months from the hirer before letting a vehicle.
1.5. Daily hire charges are calculated on a per twenty-four hour day basis.
1.6. These Terms and Conditions and the Rental Agreement are governed and construed in accordance with the laws of New Zealand.
2. Disputes
2.1. If you believe you have been incorrectly charged or have any complaint about your experience, you must inform us in writing within 20 working days.
2.2. If your booking was made through a third-party agency, we are not responsible for refund requests related to your booking. You must contact the third-party agency directly.
2.3. We aim to resolve all complaints amicably and in good faith and will try to settle disputes within 14 days.
3. Your Obligations
Payment
3.1. You will pay the amount specified in the Rental Agreement.
3.2. You may also be liable for additional charges including:
- Fuel
- Returning the vehicle later than the agreed time
- Damage to or repair of the vehicle and enforcement charges
- Traffic fines or infringement fees and administration costs
- Toll charges
3.3. At the start of the hire you must provide your credit or debit card details.
The card must be in the name of the main hirer.
We may refuse the hire if the main driver does not have a credit/debit card in their name.
At our discretion we may accept a card without the hirer's name embossed if the hirer can prove ownership (for example through online banking records).
We may place a hold up to the total value of the hire on your card.
If any loss occurs, we may charge the actual costs to your card.
3.4. No deposit is required to secure a booking. Full payment is taken on the day the rental begins. For after-hours collections payment will be taken the working day prior.
Cancellation fees may apply if the hirer cancels prior to collection.
3.5. Preferred payment methods are credit card or cash in NZD.
Card surcharges:
- Visa / Mastercard – 2.5%
- American Express – 5%
How to Use the Vehicle
3.6. You must never:
- Use the vehicle to transport passengers for hire or reward without written permission and appropriate licensing
- Sublet or hire the vehicle to anyone else
- Allow the vehicle to be used outside your authority
- Drive in breach of sections 56, 57, 57AA, 57A or 58 of the Land Transport Act
- Use the vehicle in any race, speed test, rally or contest
- Use the vehicle in breach of any traffic law or regulation
- Transport more passengers or goods than permitted
- Drive on beaches or surfaces likely to damage the vehicle
- Carry pets unless they are approved service animals
Vehicle Care Responsibilities
You must ensure:
- Reasonable care when driving and parking
- Radiator and battery water levels are maintained
- Oil levels are maintained
- Tyres remain properly inflated
- The vehicle is locked when not in use
- Nobody interferes with the odometer or speedometer
- Nobody interferes with engine, transmission, braking or suspension systems
- If warning lights appear you stop driving and contact us
- A copy of the Rental Agreement is kept in the vehicle
Accidents
3.7. Regardless of fault, if the vehicle is involved in an accident, damaged, or breaks down you must notify us immediately.
3.8. Repairs or salvage must not be arranged without our approval unless necessary to prevent further damage.
3.9. If the vehicle must be towed, the hirer is responsible for the towing cost regardless of fault.
Returning the Vehicle
3.10. The vehicle must be returned before or at the end of the hire period to the address listed on the Rental Agreement.
3.11. Ride Car Rentals is not responsible for property left in the vehicle after return.
4. Our Responsibilities
4.1. We ensure the vehicle is in a safe and roadworthy condition with a valid Certificate of Fitness.
4.2. If the vehicle requires repair or replacement during the hire period, we will discuss options with you to minimise inconvenience.
5. Cancelling This Agreement
Cancellation fees:
- 3+ days before pickup – No charge
- 1–3 days before pickup – 50% of rental payable
- Day of pickup or no-show – 100% of rental payable
If cancelled during the hire with 24 hours notice, normal rental fees still apply. Refunds for unused days may be provided at our discretion.
If the booked vehicle is unavailable we may:
- Upgrade to a better vehicle
- Provide another vehicle and refund the difference
- Offer cancellation
- Recommend another rental company if no vehicles are available
Dangerous Driving
If we reasonably believe your driving is dangerous we may:
- Cancel the agreement immediately
- Notify other rental companies for safety purposes
You must return the vehicle immediately if the agreement is cancelled.
No refund will be given if cancellation occurs due to breach of terms.
6. Privacy
We collect and use personal information in accordance with the Privacy Act 2020 for purposes including:
- Identity verification
- Payment processing
- Enforcing legal rights
Information may be disclosed to:
- Debt collection agencies
- Law enforcement
- Legal authorities
You have the right to access and correct your personal information.
Some vehicles collect journey data which we may retain for fleet management.
Information will only be kept for as long as necessary or required by law.
7. Liability
You are liable for:
- Loss or damage to the vehicle
- Consequential losses including salvage costs
- Damage to third-party property
- Debt collection costs if payment is not made
8. Insurance
You may arrange your own insurance if it provides comparable cover.
Our fleet is insured under a motor vehicle insurance policy issued by a licensed insurer in New Zealand.
We manage the insurance but do not provide insurance services directly.
Only authorised drivers listed on the Rental Agreement are covered.
Insurance coverage includes:
- Market value of the vehicle
- Up to $10,000,000 for third-party damage
Insurance Excess
Excess options:
- Elite Cover: $0 excess
- Standard Cover: $4000 excess
Elite Cover costs $35 per day (max 50 days).
Restricted or P-plate drivers must take Restricted Licence Insurance – $50/day.
Elite Cover includes:
- Windscreen and tyre protection
- Premium 24/7 roadside assistance
- Lost key replacement
Standard cover does not include these items.
Bond
A bond equal to the insurance excess will be pre-authorised on your card at the start of the hire.
The bond will be released within 5 working days after the hire if no issues occur.
Cash bonds are not accepted.
If damage occurs, the bond may be captured.
If repair costs exceed the bond, additional charges may apply.
Insurance Exclusions
Insurance does not apply if:
- The driver is under the influence of drugs or alcohol
- The vehicle is driven recklessly
- The driver is not authorised
- The vehicle is used in racing or illegal activity
- The vehicle is driven on beaches or riverbeds
- Incorrect fuel is used
- Damage results from negligence
- Accessories are lost or damaged
- A rollover occurs
- Underbody or overbody damage occurs
- Property is stolen from the vehicle
- Single-vehicle accidents occur
9. Mechanical Faults
The hirer must ensure reasonable maintenance including checks of oil, water and battery.
Roadside assistance is available at the hirer's cost, unless Elite Cover is selected.
Mechanical issues must be reported immediately.
Refunds will only be considered if Ride Car Rentals was given the opportunity to fix the issue.
Refunds may apply if a breakdown causes a 48-hour delay in travel.
10. Refunds
Refunds for breakdowns are limited to the daily rental rate.
Ride Car Rentals is not responsible for additional costs such as:
- Accommodation
- Alternative vehicles
- Travel disruptions
Refund processing may take up to 25 working days.
11. Amendments
Changes within 3 days before pickup will not reduce rental charges.
Rental extensions require authorisation and are subject to availability.
Late returns may incur:
- Daily rate
- $200 additional charge per day
Changing pickup or drop-off location may incur a $750 fee.
Early returns are not refundable.
12. Fuel
Vehicles are supplied with a full tank and must be returned full.
If returned without a full tank:
- Fuel cost will be charged
- $25 refuelling fee applies
13. Infringement Offences
The hirer is liable for offences including:
- Speeding
- Toll violations
- Red-light camera offences
- Illegal parking
- Freedom camping offences
We may transfer liability to you and charge an administration fee up to $50 per infringement.
If liability cannot be transferred, your card may be charged for the fine plus administration fee.
You have the right to challenge the infringement through the issuing authority.
14. Other Fees
Additional charges may apply:
- Cleaning fee – $200
- Smoking fee – $200
- Pet cleaning fee – $200
- Roadside call-out fees due to driver error
- Towing costs due to driver error
15. Other
Ride Car Rentals may amend these terms with 14 days notice.
We may refuse rental or terminate hire if:
- Terms are breached
- Fraud or misrepresentation occurs
- The vehicle is damaged
- The driver is considered unsafe
If terminated:
- No refund is given
- The hirer must pay towing and recovery costs
16. Consumer Rights
Nothing in this agreement removes your rights under the:
- Consumer Guarantees Act 1993
- Fair Trading Act 1986
You are entitled to receive a vehicle that is:
- Of acceptable quality
- Fit for purpose
- As described
Our services must be provided with reasonable care and skill.
